Job Title: Head of Legal & Compliance Iberia
Location: Madrid, Spain
Essential Functions
- Legal & Strategic Advice: Act as the main legal advisor for Spain and Portugal, supporting senior leaders with legal guidance. Manage legal risks related to contracts, marketing, regulatory issues, litigation, privacy, and employment matters. Ensure activities follow EU and national laws for pharmaceuticals, medical devices, and cosmetics. Advise on industry codes such as Farmaindustria and EFPIA.
- Contracts & Legal Documents: Draft, review, and negotiate contracts across business areas (e.g., distribution, services, HCP/HCO agreements). Create templates and tools to improve efficiency and consistency in contract management.
- Compliance Oversight: Ensure the affiliate complies with global policies and local laws. Lead compliance programs for transparency, anti-bribery, data protection, and competition law. Manage the whistleblower channel and handle internal investigations. Conduct risk assessments and implement preventive measures.
- Data Privacy: Oversee data protection programs. Maintain policies, conduct audits and training, and ensure compliance with privacy laws and internal protocols.
- Risk Management & Litigation: Manage legal disputes with external counsel. Support debt recovery processes. Identify and address legal and regulatory risks. Monitor legal changes and adjust policies accordingly. Oversee risks tied to public procurement and hospital tenders.
- Leadership & Culture: Promote a culture of ethics and compliance. Train employees on legal and compliance matters. Monitor the effectiveness of compliance initiatives and support ethical decision-making across the organization.
Education & Professional Background
- Law degree, qualified to practice in Spain (Portuguese legal knowledge is a plus).
- 10-15 years of experience in legal and compliance roles within pharmaceutical, medical devices, or aesthetic medicine industries.
- Strong understanding of Spanish and Portuguese legal & regulatory frameworks, including pharmaceutical law, competition law, data privacy, and industry-specific compliance regulations.
- Experience providing legal counsel in multinational environments, with exposure to EU and global regulatory frameworks.
